Trouble Again in the Open Source World

the makers of CherryOS gave up trying to market a product that was in direct violation of the copyright of PearPC.  So much evidence was found in the CherryOS code that the author's claim of writing the program entirely himself was found to be untrue.  The interesting thing about the DrunkenBlog article is the detail and research gone into the author's "flagship" product, VX30.  There is lots of code from several open source projects inside of VX30 that fall under various licenses.  Also, CherryOS never really was released and no money apparently was collected for this product.  VX30 on the other hand, has made money for the author including sales to the producers of the Golden Globe Awards.  No source code is available for this VX30 product, which is in clear violation of several of the open source software licenses.  No credit to any of the open source authors is given either, much like in the case of CherryOS.  I hope the Electronic Frontier Foundation gets involved and puts a stop to these people.

it keeps getting better and better.  These MXS people seem like real hucksters that never thought they would be caught.  I'm wondering what their customers think about them now with the high price they paid for VX30 and now knowing that a significant portion of it was freely available.  I know that the original article is long, but wow, what a report.  It is probably the best Internet read of the year.

The trouble isn't really with open source.  The trouble is that someone thought they could fool the entire open source community or maybe nobody would notice.  From later postings on DrunkenBlog, it appears that the MXS people really have no clue on how it was discovered that they were cheating in the first place.  The only statement they could muster is that they felt their source code was stolen.  They had no idea that tools are freely available to find strings in executables.  When the strings were discovered and published, MXS decided to take out each string they could find.  Incredible.  Also in the posting, is the Pakistani company that was hired to help put together CherryOS.  First, DrunkenBlog talked to the programmers that did it, then talked to the CEO of the company.  The CEO denied that his company was involved in programming CherryOS and that another completely different product that was similar was being worked on.  Then the programmers changed their minds and said they never worked on CherryOS.  Too bad though how those programmers names are in CherryOS strings.  This is one of the most hilarious stories I have read in some time.

After stating that their VX30 Ad Stats product in no way contained GPL code, they admitted that there was GPL code.  The way it has been handled, they are now in clear violation of the GPL and are no longer allowed to use any of the code at all.  They clearly stripped all copyrights to the source and the author of PHPAdStats is clearly pissed.
