SCO Loses!

SCO's 4 year attack on Linux took a huge blow this past Friday afternoon.  You may have heard champagne corks popping in IT cubes all over the world.  SCO's claim to the UNIX copyright was thrown out at that Novell was ruled the sole owner.  This will spell the end of SCO.  The entire basis of its case against Linux was the fact that they owned the code to UNIX and that Linux copied it.  This does not mention the fact that SCO could never really come up with the actual copied lines of code.  It was SCO who attacked several corporations, including IBM, that brought Novell into the picture with their assertion that they bought the copyrights to UNIX.  The judge in the case took his time in review, but his decision and explanation was quite clear in that SCO never had copyright and really knew that all along.
Microsoft has something to do with this as well.  They helped to fund Baystar (a venture capital group) which in turn gave SCO the money needed to sustain their legal battles.  This legal ruling should serve to give warning to Microsoft not to make unsubstantiated patent claims against the Linux community.  Not in one single instance has Microsoft revealed how the Linux kernel violates a Microsoft patent and yet they have negotiated "licenses" from scared second tier Linux distribution companies.  All in all, maybe it is not a huge day in open source, but it is a huge day for Linux.  Let the celebrations begin!
